Freedom of Information Act 2000 - Information Request 3347  [Number 2 is particularly interesting.]

You requested:

1.  A copy of the deliberations leading up to the signing of Coseley Baths demolition contract.

2.  An analysis of the Tendering and Contract signing process, sufficient to demonstrate adherence to Dudley Council's own rules on this matter.

Our response:

1.  Deliberations.  Decision to close was made by the Cabinet on 18th March 2009, folowing consideration of a report on the Review of Leisure Services.  this report is available on the Council's website at this link:

The decision to demolish was made by the cabinet on 9th September 2009, when setting the capital programme.  Available on the Council's website at this link:

2.  Tendering & Contract Process.  The contract was not put out to tender, it was let by way of negotiation in accordance with Council Standing Orders and by delegated authority granted to the Director of Corporate Resources set out in the constitution.  The Council entered into formal agreement with the demolition contractor on 8th march 2010.

  1. You are right, something doesn't sound right here. More fabrication. Nothing that we didn't expect from these devious creatures.(So called Councillors who are supposed to represent us.)

  2. The constitution states:
    31. NEGOTIATION 31.1 This Standing Order shall have effect where:-
    31.1.1 A Contract is to be let by way of Negotiation and
    31.1.2 The Estimated Contract Value is within available resources.
    31.2 In such cases Negotiations shall be conducted by the appropriate officers of the Council strictly in accordance with Standing Order 9.

    It clearly states that '31.1.2 The Estimated Contract Value is within available resources.'
    I'm certain that they had to borrow the money to demolish the baths, so it was not in available resources.
    Another example of bending the rules to suit themselves.
